Enabling legislation

SAT needs to be given the power to hear a matter before it can make a decision. This power comes from ‘enabling legislation’. These are the Acts, regulations, town planning schemes and by-laws that state what SAT can or can’t review or make decisions on.

You will need to know the relevant enabling legislation before you can make an application.

You can find the relevant enabling legislation by:

  • checking the letter you have received from an original decision maker for the relevant Act and section, regulation or town planning scheme, or contacting the original decision maker
  • using eCourts Portal
  • contacting SAT
  • seeking legal advice
