eLodgment for s.13 (7) Commercial Tenancy matters

The State Administrative Tribunal only accepts applications from individuals with legal representatives and organisations under section 13(7) of the Commercial Tenancy (Retail Shops) Agreements Act 1985 via eLodgment.

Applications received in any other format will not be accepted.

Using eLodgment will require registration for organisations and also for individuals representing the organisation. Once your organisation has been registered all correspondence to your organisation will be sent to the email addresss registered for the portal and can no longer be sent to individuals within the organisation.

Becoming a registered user

Becoming a registered user involves the following simple steps:

  • Complete and submit the application form - eCourts Portal Login Request Form
  • Await confirmation that your application has been accepted and processed (this may take 3 business days). You will be notified by an email containing your login details.
  • Decide on your method of payment; if you choose direct debit payment you will need to contact the Courts Technology Group to have this set up.
  • Start using eLodgment.

Before making your application, you should consider the following issues:

  • Who in your organisation will be using eLodgment and ensure they are registered users.
  • How will you pay the application fees; Direct Debit must be set up prior, alternatively enter your Credit Card details at the end of the eLodgment process for each application.

Lodgement of Commercial Tenancy 13(7) applications using the eCourts Portal

1. Do I need any special software to use eLodgment? 

No special software is required to use eLodgment other than a web browser.

2. Registration - How do I register my organisation? 

To register your organisation you will need to complete and submit an application form (eCourts Portal Login Request Form). This form requires you to identify your organisation and the individuals to be registered. You will receive an email confirmation once registered. If your organisation is already registered for eLodgment, but you want other users registered, you will need to complete an additional form for each user.

3. How will I know if the application has been successfully lodged? 

As a part of the electronic lodgment process, the user will receive an on screen confirmation that the application and or documents have been successfully lodged. Confirmation of lodgment is given in the form of a running progress screen which indicates to the user at which stage the payment and lodgment process is at. The lodgment time could take between 30 seconds and five minutes, depending on the size of the documents contained within the batch.

4. Is there a limit on the size of the document I can lodge? 

The size limit on attachments is 100MB.

5. How does eLodgment communicate with me?

With the exception of your individual login details which will initially be emailed to your personal email, all further correspondence via the eCourt portal will be sent to the Organisational email address and not to an individual's email. The message will indicate that you have new unread correspondence waiting in you eCourts Portal and you will need to login to access these messages. This will include any orders that are made by the Tribunal.

6. Who do I contact if I have a difficulty with eLodgment? 

If the difficulty concerns the technical operation of eLodgment, then you should contact the Courts Technology Group Helpdesk on (08) 9425 2645 from 8:15am to 4:45pm (WST) Monday to Friday, or you can send a message to ctghelpdesk@justice.wa.gov.au at any time.
